Spain's Coastal Law and renovating a seafront house: what is allowed

Renovating an existing house in the coastal protection zone is allowed if volume, height and floor area do not grow and energy efficiency improves. Extending or rebuilding is not. Zones, procedure and typical mistakes.

Can you renovate a house by the sea under the Coastal Law?

Yes, if it is repair and not extension. In the coastal protection zone the law allows repair, improvement, consolidation and modernisation of an existing house as long as volume, height and floor area do not increase. The works must improve energy performance by two letters or to grade B and use water-saving systems. New dwellings and extensions are prohibited.

The rule sits in the transitional provisions of Coastal Law 22/1988, as amended by Law 2/2013. It protects houses built under a municipal licence (and, where required, a state authorisation) granted before the law came into force in 1988, and regularised buildings. A house built without permits has to be regularised first; if that is not possible on public-interest grounds, the fourth transitional provision (paragraph 1) foresees demolition.

For a high-end owner the conclusion is simple. A good seafront project is built on quality, not on square metres: new windows and glazing, insulation, climate control, services, kitchens and bathrooms, finishes and landscaping within what is allowed. You cannot add floor area, but you can improve the house almost without limit while staying inside the volume it already has.

What zones surround the shoreline and how wide is each?

Four different restrictions start from one line: the inner limit of the shore (ribera del mar), fixed by the approved boundary survey (deslinde). Not from the water's edge and not from the road.

The narrowest is the transit easement: six metres inland from that line, which must stay free for pedestrians and patrol vehicles (article 27). In difficult places it can widen to 20 metres. Next is the protection easement: 100 metres from the line (article 23.1), which can be extended by up to another 100 metres. On land that was urban in 1988 its width is 20 metres (third transitional provision, paragraph 3). That rule explains why, in older districts of Castelldefels, Sitges or the Maresme, neighbouring houses can be in different legal positions.

The third is the sea-access easement (article 28): plans must provide access to the shore and works that cut such access are not allowed. The fourth is the zone of influence (article 30): at least 500 metres from the line, where planning must avoid architectural screens and accumulation of volumes. In Catalonia, Law 8/2020 on the protection and planning of the coast sets a minimum of 1,000 metres (article 2.2). The zone of influence does not ban renovation but it shapes what can be newly built.

Renovation within the first 100 or 20 metres is governed as an exception. Further from the line the usual rules apply: municipal licence, development plan, Technical Building Code.

What counts as repair and what counts as extension?

There is one test: do the volume, height or floor area of the existing building grow? If not, it is repair, improvement, consolidation or modernisation. If so, it is an extension, and in the protection zone that is prohibited.

Usually counted as renovation: a new roof and facade within the same envelope, new windows and glazing, structural strengthening, a new layout inside the volume, new services, kitchens and bathrooms, insulation, new floors and replacement of staircases. Counted as extension: adding a storey, enclosing a terrace to create new interior area, attaching a porch or a garage, raising the roof, a basement under the house with new floor area. Grey cases are glazing a terrace, a winter garden, a new pool or covering a pergola. There the town hall and the Generalitat body decide, and there is no general answer: submit a sketch with figures and ask for their view before commissioning the design.

Two phrases from the law are worth knowing. First: the increase in value that works bring is not counted for expropriation purposes (fourth transitional provision, paragraph 2). Second: in the event of total or partial demolition, new construction must comply fully with the law. Since article 25 prohibits dwellings in the protection zone, demolishing and rebuilding strips you of the rights to the old volume. If a house has to be transformed deeply, plan the work to keep the structural frame, and agree that before the design.

An example. A 1970s villa on the front line: new roof and insulation in the same envelope, floor-to-ceiling glazing in the existing openings, kitchen and bathrooms moved within the plan, new services, a terrace pool handled through a separate approval. That is renovation. Adding a 40 m² wing is not possible.

Can you rebuild a house 100 metres from the sea?

It depends on how the plot is classified and where the boundary line runs. One hundred metres is not a single figure but the edge of the protection zone for land that was not urban in 1988. On urban land the width is 20 metres (third transitional provision, paragraph 3). So a house 100 metres from the line on urban land lies outside the protection zone and its rebuilding is judged by the town hall under the ordinary plan. A house 80 metres away on non-urbanisable land lies inside.

But outside the zone there are limits too. The zone of influence (at least 500 metres, in Catalonia at least 1,000) requires planning to avoid walls of continuous building, and a works licence that involves discharges into the maritime-terrestrial public domain needs a prior discharge authorisation (article 30.2). For new construction far from the protection zone, the plan, height, site coverage, beach and environmental limits and protected-area regimes apply.

How to proceed. First, ask the town hall for the planning data for the plot (land classification, parameters, zones). Second, have a surveyor draw a plan showing the boundary line and the distances to the house and the plot limits. Third, ask the Coastal Demarcation and the Generalitat body in writing which zone the property falls into. Only then commission a sketch. The costliest mistake is to buy a plot or house counting on an extension before knowing where the line runs.

Do you need coastal authority approval for a renovation?

In the protection zone you need a declaration of responsibility and a municipal licence; if the transit easement is affected, a report from the state body too. The town hall cannot grant the licence for this renovation until you have filed a responsible declaration (declaración responsable) with the competent body of the autonomous community. In it you state that the works will not increase volume, height or area and that the house will achieve an energy improvement of two letters or grade B and use water-saving systems (fourth transitional provision, paragraph 3). The grade is evidenced by an energy performance certificate.

If the house or part of it lies in the transit easement (the first six metres), a favourable report from the State Administration confirming that the passage remains free is needed before the licence. The period is two months and, if no report is issued, it is deemed favourable (fourth transitional provision, paragraph 2.b). If the house ended up in the protection easement after the boundary line was revised, the same conditions apply (article 13 bis, paragraph 3).

Practical order. First, the energy certificate of the house before works, so you have the starting grade. Then the design showing that floor areas do not grow, with the improvement calculation. Then the responsible declaration to the Generalitat body and the licence application to the town hall. The exact body and form should be confirmed with the town hall and your gestor: the Generalitat's structure has changed over the years, so do not rely on old names found online. Deadlines and fees should likewise be taken from current pages before you plan the timetable.

A practical warning on the energy grade: improving by two letters or to B means a seafront renovation will include insulation, new windows and efficient climate systems. Build that into the estimate from the start.

How do you check whether a house falls in the coastal protection zone?

You need three documents: the town hall's planning information, a surveyor's plan with the boundary line, and a written reply from the coastal body. The line is set by the approved boundary survey (deslinde), not by a distance measured on a map. When the survey is revised, houses that used to be outside can end up inside the protection easement (article 13 bis).

The steps. First, ask the town hall for the plot's information sheet, with land classification and current parameters. Second, hire a surveyor and give him the approved boundary survey for that stretch; he will draw the line and the 6, 20 and 100 metre limits on the cadastral plan and show the distances to the house and the fence. Third, ask the Coastal Demarcation and the Generalitat body which zone the property falls in and what requirements apply. The written reply becomes part of the package for the bank, the notary and the insurer.

If you already own the house, check it has a legal basis: a construction licence, a cadastral area that matches the real one, no earlier extensions without permission. Areas that are not in the old licences will have to be regularised or demolished, and then the renovation turns into a different project. Do not take the agent's word that the house is old and nothing is needed. An overseas buyer should allow a few weeks for this check before signing the reservation contract, not after.

For properties in Castelldefels, Gavà, Sitges and the Maresme this analysis is essential: in many cases front-line plots come from old developments, and land classification and licence dates have to be reconstructed from archives. There is a separate guide on regularising old works.

Which mistakes cost the most when renovating a seafront house?

Five mistakes repeat more than the rest. First: buying a house counting on an extension without establishing the zone. A house that can only be renovated is worth something different from one with spare buildable volume. Second: starting works on a declaration without agreeing it with the town hall, thinking it is just a renovation. The law is clear that without the declaration the licence cannot be granted. Third: designing as demolish and build a new villa. In the protection zone, demolition wipes out the rights to the old volume.

Fourth: estimates that leave out the energy efficiency improvement. The condition of two letters or grade B requires insulation, windows and climate systems, and if the estimate omits them, the cost grows at the approval stage. Fifth: ignoring humidity and salt. By the sea, facade materials, metalwork and windows work in a more aggressive environment: A4 stainless steel instead of A2, anodised aluminium with reinforced protection, careful sealing of junctions and ventilated cavities behind cladding. This is engineering practice, not a rule of the law, but it shows in the quality of a contractor.

What the budget is made of. In the high-end segment by the sea most of the cost does not go into square metres but into windows and glazing, the facade, climate systems, finishes and surroundings. Guide prices excluding VAT: Luxury from 2,000 €/m², Signature from 3,000 €/m²; the exact price is in the estimate after a visit and measurements.

How does BCN YARD handle seafront renovations?

We handle houses and villas on the coast and in the province of Barcelona in Russian and Spanish. One person responsible for the site, our own crew and trusted subcontractors, payment by stages under the contract. Project signatures are provided by independent specialists.

If you are looking at a house by the sea, send us the cadastral reference and photos. We reply within an hour and tell you which questions to put to the town hall and the coastal body before you buy. After a visit and measurements we prepare an estimate with separate lines for windows, facade, climate systems and energy performance, so the approval stage does not raise the budget suddenly. Preparing and filing the documents can be done together with the renovation: see our permit support service. For Castelldefels, Gavà, Sitges and the Maresme we have area pages.

Frequently asked questions

Can I rebuild a house 100 metres from the sea?

It depends on land classification. On urban land the protection zone is 20 metres wide, so a house 100 metres away is outside it, though the development plan and the zone of influence still apply. On non-urban land, 100 metres is exactly the edge of the protection zone. The boundary line decides, so start with a surveyor's plan and the town hall's information.

Which works does the Coastal Law prohibit?

In the protection zone the law prohibits residential buildings, new inter-urban roads, overhead high-voltage lines, dumping of waste and untreated wastewater, and billboard advertising (article 25). For an existing house that means no extension and no new building. Renovation without increasing volume, height or area is allowed.

Do I need coastal authority permission for a renovation?

In the protection zone you need a responsible declaration to the autonomous community's body and a municipal licence. If the transit easement (the first six metres) is affected, a favourable report from the State Administration is added: two months, with silence deemed favourable. Confirm the exact body and form with the town hall.

How can I check if my house is in the coastal protection zone?

Ask the town hall for planning information, have a surveyor draw a plan with the approved boundary line and the 6, 20 and 100 metre limits, and put the question in writing to the coastal body. A distance on a map or on an agency listing decides nothing: only the approved line counts.
